連合国軍最高司令官総司令部（GHQ）により「超国家主義団体の解体の指令」（SCAPIN-548）が出される

　今日は、昭和時代中期の1946年（昭和21）に、連合国軍最高司令官総司令部（GHQ）により「超国家主義団体の解体の指令」（SCAPIN-548）が出された日です。

　「超国家主義団体の解体の指令」（ちょうこっかしゅぎだんたいのかいたいのしれい）は、昭和時代前期の太平洋戦争後の連合軍占領下において、「ポツダム宣言」の第6条「日本国国民を欺瞞し、之をして世界征服の挙に出づるの過誤を犯さしめたる者の権力及び勢力は、永久に除去せられざるべからず」に基づき、1946年（昭和21）1月4日に出された、GHQの連合国最高司令官指令第548号（SCAPIN-548）のことでした。英語名は、「Abolition of Certain Political Parties, Associations, Societies and Other Organizations」と言います。
　日本政府に対し、政党、協会、結社、その他の組織の設立、およびそれらの一部、またはその目的または活動の結果が超国家主義である個人またはグループの活動を禁止するよう指示したものでした。これによって、超国家主義団体とされた、大日本一新会、大日本興亜連盟、日本生產党など27団体の結社を廃止し、活動を禁止しています。
　同じ日には、「公務従事に適しない者の公職からの除去に関する件」（SCAPIN―550）も出されました。

MEMORANDUM FOR：IMPERIAL JAPANESE GOVERNMENT.

THROUGH：Central Liaison Office, Tokyo.

Subject：Abolition of Certain Political Parties, Associations, Societies and Other Organizations.

1. You will prohibit the formation of any political party, association, society or other organization and any activity on the part of any of them or of any individual or group whose purpose, or the effect of whose activity, is the following.

a. Resistance or opposition to the Occupation Forces or to orders issued by the Japanese Government in response to directives of the Supreme Commander for the Allied Powers, or,

b. Support or justification of aggressive Japanese military action abroad, or;

c. Arrogation by Japan of leadership of other Asiatic, Indonesian or Malayan peoples, or;

d. Exclusion of foreign persons in Japan from trade, commerce or the exercise of their professions, or;

e. Opposition to a free cultural or intellectual exchange between Japan and foreign countries, or;

f. Affording military or quasi-military training, or providing benefits, greater than similar civilian benefits, or special representation for persons formerly members of the Army or Navy, or perpetuation of militarism or a martial spirit in Japan, or;

g. Alteration of policy by assassination or other terroristic programs, or encouragement or justification of a tradition favoring such methods.

2. List of organizations, some or all of whose purposes are prescribed under the provisions of paragraph 1 above is given in Appendix A to this Memorandum. This list will not be regarded as inclusive The organizations listed in that appendix and other organizations, whose purposes or activities are those above mentioned or similar to them, will be immediately dissolved, together with any organizations which they control or with which they are affiliated.

3. a. You will take such action immediately as may be required to prevent all transactions involving property owned or controlled, directly or indirectly, in whole or in part, by any organization dissolved or to be dissolved in accord with this Memorandum or of the type enumerated in paragraph 1 hereof. All such property, including all books, files and records of such organizations, will be seized and held in your custody. You will obtain complete records of all such property and will keep them available for inspection as public records, Officials receiving such records will be held personally responsible for their safe keeping and use in accord with this Memorandum. Any such property which is capable of use for the production of food, shelter or other necessities of life will be exploited as promptly as possible for those purposes.

b. You will promptly obtain and submit to this Headquarters the name and address and the position held by each person who has, at any time since 7, July 1937, served as an officer of any organization dissolved in accord with this Memorandum. Such information will also be kept available as a public record. Complete membership lists will also be furnished.

4. You will enact appropriate laws or ordinances to carry out the terms of this Memorandum and to prevent further activities contrary to its terms.

5. Until further order of the Supreme Commander for the Allied Powers, any organization shall be deemed, regardless of its declared purposes, to further purposes or activities contrary to the terms of this memorandum if:

a. Any of its principal officers were (i) members of organizations abolished in accord with this order, or (ii) former commissioned officers of the Imperial Japanese Regular Army or Navy or the Special Volunteer Reserve, who have been on active duty since 1 January 1930, or (iii) any person who has served in or with the military police (Kempei-Tai) or Naval Police, the TOKUMU KIKAN, KAIGUN TOKUMU BU, or other special or secret intelligence or military or naval police organizations.

b. Its membsrship includes more than twenty-five percent of persons who were formerly members of an organization or organizations abolished or prohibited in pursuance of this Memorandum.

6. You will forbid the formation or activity of any party, society, organization, association or group whose purpose or activity consists of:

a. Proposing or supporting candidates for public office.

b. Influencing the policy of Government, or

c. The discussion of the relations between Japan and foreign powers, unless it shall first have filed a declaration of (a) its name, (b) its purposes, (c) the address of its principal offices, (d) the names and addresses of its officers together with a statement as to their military or police service and the names of any associations, societies or parties of which they are or have been members, (e) the names and addresses of substantial financial supporters and the amounts of their respective contributions, (f) a roster of the names and addresses of its membership in the office of the mayor of the town or city in which it has or intends to have its principal office. Such declarations will be kept up to date as changes in purposes and membership occur. Declarations with regard to changes of membership and substantial contributions will be made as required by the Supreme Commander; reports of changes in officers or purposes will be made immediately. You will direct that the mayor of any town or city receiving such a declaration or any change forward two copies to an appropriate office of the Imperial Japanese Government in Tokyo. Both the original and one of the copies of such declarations will be kept available for public inspection at all times during ordinary business hours. No fees will be charged in connection with any of the foregoing and thh procedure fixed for filing such declarations shall be such as to make compliance with these directions as simple and easy as possible.

The provisions of this paragraph which require the filing of a roster of the names and addresses of members will not apply to groups or other organizations of workers or employees who meet for the purpose of the discussion of questions relating to wages, hours and working conditions or the choice of persons to represent them in negotiation with their employers in connection with such questions.

7. The purpose of the provisions of paragraph 6 of this Memorandum is to secure public knowledge of the character of political organizations in Japan and to prevent the formation of secret, militaristic, ultra-nationalistic and anti-democratic societies and organizations. It shall not be interpreted nor shall it be applied in a manner which interferes with freedom of assemble, speech or religion except with respect to the purposes and activities specifically mentioned herein.

8. You will present your program for the execution of the directions of this Memorandum, together with any laws, ordinances or orders to be issued in accord with it, for the approval of the Supreme Commander for the Allied Powers. Any laws or ordinances which you will enact in compliance with this Memorandum will provide that upon such approval they will be effective from the date of this Memorandum, regardless of the date of their enactment.

或る種類の政黨、協會、結社その他の團體の廢止に關する覺書

一九四六年一月四日

一　日本國政府は、その目的又はその活動の結果が左の事項に該當する政黨、協會、結社、その他の團體の結成並にそれらの團體又は個人若は集團の活動を禁止しなければならない。

（a）占領軍に對する反抗若は反對又は聯合國最高司令官の指令に基いて、日本國政府が發した命令に對する反抗又は反對。

（b）日本國の侵略的對外軍事行動の支持又は正當化。

（c）日本國が他のアジア人、インドネシア人、マレー人の指導者たることの僭稱。

（d）日本國內に於ける外國人の貿易、商業又は職業從事からの除外。

（e）日本國と諸外國との間で行はれる自由な文化又は學術の交流に對する反對。

（f）日本國內に於ける軍事上の訓練若はこれに準ずるやうな訓練の實施、元陸海軍々人であつた者に對する同等の民間人に與へられる以上の利益の供與、若は特別な發言權の付與又は軍國主義若は軍人精神の存續。

（g）暗殺その他の暴力主義的計畫による政策の變更又はそのやうな手段を促すやうな傾向の奬勵若は正當化。

二　第一項の條項の中で指定したやうな目的を、全部の場合は勿論一部でも持つてゐる團體は、この覺書に添へた附錄Aに表記されてゐる。その表は全部を網羅したものではない。右の附錄に記載してある團體と、右に述べたやうな目的を持つたり、活動をしたりする團體、又はこれに類似する目的活動を持つ團體は、直ちに解散しなければならない。又以上の團體が支配して居る團體若はそれらと密接な關係を持つてゐる團體も同樣解散しなければならない。

三　（a）日本國政府はこの覺書によつて解散された團體、又は解散しなければならない團體、更に又この覺書の第一項に擧げた種類の團體が、直接間接に、全體又はその一部を所有したり支配したりしてゐる資產に關する取引を完全に抑へる爲めに必要な處置を直ちに取らねばならない。このやうな資產はその團體の帳簿、綴込書類、記錄と一緖に接收して、日本政府が保管しなければならない。尙日本政府は、右に述べた資產について完全な記錄を作り、公の記錄として何時でも檢閲を受けられるやうしておかねばならない。これらの記錄を受け取る官吏は、それを安全に保管することに對して、個人として責任を持たねばならぬ。食糧とか、家屋とか、その他日常生活必需品の生產に使用出來る資產は總て、出來るだけ早くその目的に副ふやう利用せねばならない。

（b）日本政府は一九三七年七月七日以後、時期に拘らず、この覺書によつて解散された團體の役員であつた人々について、氏名と住所とその團體で占めてゐた地位を直ちに調查して、聯合國最高司令部に提出しなければならない。この報吿も公の記錄として保管する必要がある。同時に團體に屬してゐた人員全體の名簿をも備へておかなければならない。

四　この覺書の條項を實施する爲め又今後この規定に反する活動をさせない爲めに、適當な法律なり法令を發布しなければならない。

五　聯合國最高司令官から改めて指令の出る迄は、どのやうな團體でも、又その宣言した目的に關係なく、左に述べる項目に當てはまるときは、この覺書に反した目的活動を促進するものと見做される。

（a）その重要役員の中に左に述べるやうな者の居る場合。卽ち（1）この指令によつて廢止された團體の團員。（2）一九三〇年一月一日以後、元日本帝國の正規の陸海軍の將校又は特別志願豫備將校であつた者。（3）憲兵隊、海軍警察、特務機關、海軍特務部、又はその他特別の機關或は祕密情報機關、陸海軍警察機關に勤務した者、又はこれらの機關に關係ある勤務をした者。

（b）團體員のうちに、この覺書によつて解散又は禁止された團體の元の團員を、四分の一以上含んでゐるもの。

六　次に述べるやうな目的と活動を持つて成立してゐる政黨、結社、團體、協會又は集團はその結成又は活動を禁止しなければならぬ。

（a）公職の候補者を推薦し又は援助するもの。

（b）政府の政策に影響を及ぼすもの。

（c）日本と諸外國との關係を論議するもの、但し次に述べるやうな申吿を提出したものは例外とする。（1）その名稱、（2）その目的、（3）その主たる事務所の所在地、（4）その役員の氏名と住所、これには軍部又は警察關係での勤務、從來屬してゐたか又は現在屬してゐる聯盟、協會又は政黨の名稱に關する記錄を添えること、（5）實質的に財政上の援助をする者の氏名と住所、並にその援助の金額、（6）その會員の氏名及び住所の名簿、これ等をその主たる事務所が現在あるか、又は今後置かれようとする市町村役場に、提出すること。上に述べた申吿は、目的や會員の變化に應じて常にその現狀を明らかにして置くこと。會員や實質的な援助の金額に變化のあつた場合は聯合國最高司令官の要求通り申吿をすること。職員や目的に變化のあつた場合は直ちに報吿すること。日本國政府は、右に述べたやうな申吿又は報吿を受けた市町村長は、その申吿なり報吿を二通宛、東京の日本政府關係官廳に送るやう命令しなければならない。申吿書の原本と寫一通を勤務時間中常に備へておき、一般に閲覽を受けられるやうにしておかねばならない。以上の手續に對しては一切料金を徵收せず、又申吿書提出の爲めに定められる手續も、この覺書の指令を最も簡單容易に履行出來るやうなものとしなければならない。

この項目の規定は、團體に屬する人々の氏名と住所の名簿を提出するやう要求してゐるけれども、賃銀、勞働時間、勞働條件等の問題を論議したり、又はこれらの問題について、雇主と交涉する際に、勞働者又は雇傭人の代表者を選ぶ目的で集合した勞働者或は雇傭人の團體とか、その他の組織體にはこれらの規定は適用しない。

七　この覺書第六項の規定は、日本の政治團體の性格について一般公衆に間違ひのない知識を持たせ、祕密的な、軍國主義的な超國家主義的な、又は反民主主義的な結社や團體の結成を防止することを目的とするものである。この規定は、特にこの覺書の中で述べてゐる目的や活動に關係するものを除き、集會、言論、宗敎等の自由に干涉するもののやうに解釋してはならない。又それらの自由に干涉するやうに適用されてはならない。

八　日本國政府は、この覺書の指令を實施する爲めの計畫に、この指令に基いて發布しようとする法律、勅令或は命令を添え、聯合國最高司令部に提出して、その承認を受けねばならない。尙この覺書に基いて、日本國政府の發布する法律や命令が、聯合國最高司令官の承認を受けた場合は、すべてその發布の日の如何に拘らずこの覺書の發せられた日から有効となることを規定せねばならない。

平洋戦争後の占領下において、連合国最高司令官指令（SCAPIN）として、日本国政府に対して、「映画企業に対する日本政府の統制の撤廃に関する覚書」 (SCAPIN-146) が指令される

　今日は、昭和時代前期の1945年（昭和20）の太平洋戦争後の占領下において、連合国最高司令官指令（SCAPIN）として、日本国政府に対して、「映画企業に対する日本政府の統制の撤廃に関する覚書」 (SCAPIN-146) が指令された日です。
　「映画企業に対する日本政府の統制の撤廃に関する覚書（えいがきぎょうにたいするにほんせいふのとうせいのてっぱいにかんするおぼえがき）」は、連合国最高司令官指令（SCAPIN）として日本国政府に対して発せられた基本的施策を定める指示・訓令の一つでした。まず1945年（昭和20）9月10日に、「言論及び新聞の自由に関する覚書」 (SCAPIN-16) が指令され、続いて9月27日に「新聞、言論の自由への追加措置」 (SCAPIN-66) が出されていましたが、10月16日に出された、この指令 (SCAPIN-146) は、さらに、日本政府に対して、ニュース映画を含む映画の言論の自由に関する平時および戦時の制限の実施手順を無効にすることを指令したものです。また、10月4日の「政治的、公民的及び宗教的自由に対する制限の撤廃に関する覚書（民主化指令）」（SCAPIN-93）もこれに適用すべきものとしました。
　これによって、それまで行われてきた「映画法」に基づく日本政府による映画の検閲は無効とされます。しかし、翌年1月28日に「映画検閲に関する覚書」（SCAPIN-658）が出され、日本政府に対し、映画・幻燈画（物語、教育、漫画、ニュース映画の全編）のすべての所有者および製作者に、16mmまたは35mm、サイレントまたはサウンドの区別なく、1946年2月28日までに民間検閲局（CCD）に、すべての無修正映画の完全なリストを提出するよう指示、これらの中で民間検閲識別番号を持たないものを聴衆に対して供覧することを禁止しました。
　これによって、連合国軍最高司令官総司令部（GHQ）による二重検閲が始動、英訳した企画書や脚本を民間情報教育局（CIE）映画課に事前提出する〈民間検閲〉と完成後に民間諜報局傘下の民間検閲支隊（CCD）プレス・映画・放送部門から民間検閲認証番号を得る〈軍事検閲〉が行われるようになります。それは、新作だけでなく、旧作の再上映にも認証番号制を敷くことになりました。
　さらに、同年11月16日にGHQは、「非民主主義映画除去の指令に関する覚書」（SCAPIN-287）を発令、全455作品の中から選ばれた封建主義的・国家主義的・軍国主義的な236作品（日活映画「薩摩の密使」以下48篇、松竹映画「宮本武藏」以下53篇、大映「紅顏鼓笛隊」以下62篇、東宝映画「日本劍豪傳」以下51篇、日本映画「轟沈」以下11篇、興亜映画「菊水とはに」1篇、新興映画「熱血の道」1篇、朝鮮映画「若き姿」1篇、藝術映画「鬪ふ輸送船團」1篇、朝日映画「陸鷲誕生」以下2篇）の長編劇映画、そして戦中に製作されたほとんどすべてのニュース映画や文化記録映画の上映、交換、売買を禁止し、それらを地方自治体ごとの綿密な探索により没収します。その後、1948年（昭和23）に、GHQは社団法人日本映画製作者連盟（映連）に対して自主的な審査機能を設置するよう促し、翌年には、映画倫理規程管理委員（映倫）が設置されました。
　これで、GHQの二重検閲は、CIEの事後検閲のみとなり、1952年（昭和27）4月28日の「サンフランシスコ平和条約」の発効まで続きます。

MEMORANDUM FOR：IMPERIAL JAPANESE GOVERNMENT.
THROUGH：Central Liaison Office, Tokyo.
SUBJECT：Elimination of Japanese Government Control of the Motion Picture Industry.

1. Further to the directive of 27 September 45 from the Supreme Allied Commander, titled “Further Steps toward Freedom of Press and Speach,” the Japanese Government forthwith will render inoperative the procedures for enforcement of peace-time and war-time restrictions on freedom of speach in motion pictures, including newsreels.

2. The directive of 4 October 45, titled “Removal of Restrictions on Political, Civil, and Religious Liberties,” also shall apply.

3. Pending repeal of laws imposing restrictions on the motion picture industry, making it a channel for dissemination of propaganda, their enforcement shall be suspended.

4. No punitive action will be taken by the Japanese Government or any of its agencies against motion picture companies, producers, actors, directors or other persons or associations of persons engaged in the motion picture or legitimate theater industry for exercising their lawful freedom of speech.

5. Steps shall be taken to repeal the following laws and/or regulations which are inconsistent with the Supreme Commander's directives enumerated in paragraphs 1 and 2 of this order, subject laws including but not restricted to:

In addition to rendering the foreign laws inoperative, necessary instructions will be issued to prefecture and metropolitan authorities, including police agencies, directing their repeal of any and all local censorship rules, regulations or laws, to insure that the spirit of the directives in observed by them.

7. Steps shall be taken to repeal the following Tokyo Metropolitan Police regulations:

These laws, rules or regulations give broad supervisory powers to the police, in addition to their censorship provisions. Such powers include deciding who shall work in the industry, passing on the financial condition of an owner, checking on the behavior or attitude of an employee, controlling the proportion of foreign films exhibited, preventing actors from walking on the street in stage costume, determining the issuance of passes, and examning the minutes of a stockholder’s meeting. These powers, no free people, can entrust to a police.

8. The few sections of these rules which deal with matters of Safety Regulations and Building and Zoning restrictions shall remain in effect until the Japanese Government shall re-enact such regulations for the protection and safety of the public against fire and structural hazards in the motion picture industry.

9. Necessary instructions will be issued to Prefectural Authorities including all police agencies, directing the repeal of any and all similar local rules, regulations or laws which conflict with the spirit or intent of this directive.

10. It is the purpose and intent of this directive to free the Japanese motion picture industry from government domination and to permit the industry to reflect the democratic aspirations of the Japanese people. In due time (when the Japanese motion picture companies have demonstrated good faith), it is envisaged that they will establish an industry-wide committee which will act as a policing agency.

11. The report required of the Japanese Government in paragraph 8 of the directive of 27 September will include a statement of action taken to comply with this directive.

　今日は、昭和時代中期の1946年（昭和21）の太平洋戦争後の占領下において、連合国最高司令官指令（SCAPIN）として、日本国政府に対して「日本史授業再開に関する覚書」（SCAPIN-1266）が指令された日です。
　「日本史授業再開に関する覚書（にほんしじゅぎょうさいかいにかんするおぼえがき）」は、連合国最高司令官指令（SCAPIN）として日本国政府に対して発せられた基本的施策を定める指示・訓令の一つでした。戦前の皇国史観が色濃い国史の教科書には、国家主義や戦意を鼓舞する内容の多くの記載があり、当初はそのような記述のある箇所を黒く墨塗りにして削除させていましたが、1945年（昭和20）12月31日に指令された「修身、日本歴史及び地理停止に関する件」（SCAPIN-519）で、授業そのものを停止させられ、教科書も回収させられます。
　それを修正し、この指令によって、文部省が作成し、連合国最高司令官が承認した教科書で、日本史授業を再開するように指示したものでした。これに基づいて、同年10月から文部省が作成した暫定教科書「くにのあゆみ」を使用して、国民学校（小学校）における日本史授業は再開されています。
　また、先行して同年6月29日には、「地理授業再開に関する覚書」（SCAPIN-1046）も出されて、同じ条件で地理の授業の再開も許可されていました。しかし、修身については、公民という全く新しい科目が設置され、同年9月から公民科が課されています。

☆「修身、日本歴史及び地理停止に関する件」（SCAPIN-519）とは？

　太平洋戦争後の連合軍占領下において、1945年（昭和20）12月31日に、連合国軍最高司令部（GHQ）が出した指令（SCAPIN）で、正式には、「修身、日本歴史及び地理停止に関する件」（SCAPIN-519）といい、といい、GHQ教育四大指令の一つとされています。
　文部省に対し、すべてのコースおよび教育機関で使用されている終身科、国史科、地理科に関する教科書および教師用マニュアルをすべてを使用中止とするよう指示し、指令部の許可あるまで再開しないようにしたものでした。そして、代替用教科書の改定案を準備し、連合国最高司令官に提出することとしています。
　その後、翌年6月29日の「地理授業再開に関する覚書」（SCAPIN-519）で地理授業の再開を許可、10月12日の「日本史授業再開に関する覚書」（SCAPIN-1266）で日本史授業の再開を許可していますが、文部省が作成し、連合国最高司令官が承認した教科書を使用することが条件とされました。

1. In accordance with the basic directive AG 000. 3 (15 Dec 45) CIE proclaiming the abolition of government sponsorship and support of State Shinto and Doctrine, and
Inasmuch as the Japanese government has used education to inculcate militaristic and ultra-nationalistic ideologies which have been inextricably interwoven in certain textbooks imposed upon students,
It is hereby directed that:
a. All courses in Morals (Shushin), Japanese History, and Geography in all educational institutions, including government, public, and private schools, for which textbooks and teachers’ manuals have been published or sanctioned by the Ministry of Education shall be suspended immediately and will not be resumed until permission has been given by this headquarters.
b. The Ministry of Education shall suspend immediately all ordinances (Horei), regulations, or instructions directing the manner in which the specific subjects of Morals (Shushin), Japanese History, and Geography shall be taught.
c. The Ministry of Education shall collect all text books and teachers’ manuals used in every course and educational institution affected by 1, a. for disposal in accordance with the procedure outlined in Annex A to this memorandum.
d. The Ministry of Education shall prepare and submit to this Headquarters a plan for the introduction of substitute programs to take the place of courses affected by this memorandum in accordance with the procedure outlined in Annex B to this memorandum. These substitute programs will continue in force until such time as this Headquarters authorizes the resumption of the courses suspended herein.
e. The Ministry of Education shall prepare and submit to this Headquarters a plan for revising textbooks to be used in Morals (Shushin), Japanese History and Geography in accordance with the procedure outlined in Annex C to this memorandum.

2. All officials, subordinates, and employees of the Japanese Government affected by the terms of this directive, and all school officials and teachers, both public and private, will be held personally accountable for compliances with the spirit as well as the letter of the terms of this directive.

Annex A
Procedure For Collection of Textbooks and Manuals.
The Ministry of Education shall collect all textbooks and teachers’ manuals used in every course and educational institution for which teaching materials in the subjects of Morals (Shushin), Japanese History, and Geography have been prescribed, published, or sanctioned by the Ministry.
For the Tokyo, Kyoto, Osaka, and Kobe areas, the collection of these teaching materials shall be accomplished as soon as possible and, in any event, not later than the beginning of the Spring Term of School, 1946, at which time a report shall be submitted to this Headquarters, stating the total number of volumes collected, the gross weight of these volumes, and the specific location where these teaching materials have been collected.
In addition, a detailed report shall be submitted to this Headquarters, on 1 April 1946, for the collection of similar textbooks and manuals in all other areas of Japan. This plan shall include: the orders to competent prefectural authorities, reference to this Memorandum, and detailed instructions on the collections, number; weight, and availability for shipping of these teaching materials to designated pulping centers for the manufacture of paper.

Annex B
Plan For Submission of Substitute Programs.
The Ministry of Education shall prepare and submit as soon as possible to this Headquarters a plan for the introduction of substitute programs to take the place of courses affected by this Memorandum. These substitute programs will continue in force until such time as this Headquarters authorises the resumption of the courses suspended herein.
This plan shall aim at presenting fundamental social, economic and political truths, relating them to the world and life of the students.
These truths shall be taught through classroom discussion based in part on materials sponsored by this Headquarters. Whenever possible, the discussion will be correlated with current events.
The Ministry of Education will issue teachers’ manuals explaining the purpose of the program, prescribing discussion methods which will encourage independent thinking, outlining the major topics to be discussed and listing press, radio, pamphlet and other materials to be used.

Annex C
Procedure For Submission of Revised Program.
The Ministry of Education shall prepare and submit as soon as possible for approval to this Headquarters, a plan for revising textbooks and teachers’ manuals used in Morals (Shushin), Japanese History, and Geography courses.
This plan shall have for its objective the preparation of temporary teaching materials which will be available for the Spring Term of the 1946 school year.
The details to be covered in this plan will include: personnel for the preparation of teaching materials, selection of suitable subject matter, translation into English, consultation with and approval from this Headquarters, printing, and distribution of materials.

　今日は、昭和時代前期の1945年（昭和20）に、GHQが「言論及び新聞の自由に関する覚書」（SCAPIN-16）により、占領下の日本のマス・メディアの一般的な行動基準を示し、その日から新聞や雑誌などの事後検閲を開始した日です。
　昭和時代前期の太平洋戦争敗戦後の連合国軍占領下で、連合国軍最高司令官総司令部（GHQ）によって、1945年（昭和20）9月10日に発令された、連合国最高司令官指令第16号（SCAPIN-16）の「Memorandum to Japanese Government Concerning Freedom of Speech」のことです。占領下の日本のマス・メディアの一般的な行動基準を示し、その日から新聞や雑誌などの事後検閲を開始していますが、言論の自由はGHQ及び連合国批判にならずまた太平洋戦争の被害に言及しない制限付きで奨励されました。この後、9月19日にその行動基準を新聞、出版についてより具体的に示した「日本に与うる新聞遵則（プレスコード）」（SCAPIN-33）が出され、9月22日には、ほぼ同趣旨でラジオ放送向けに「日本放送遵則（ラジオコード）」（SCAPIN-43）が発せられています。10月9日からは主要新聞・雑誌がこれに基づく事前検閲を受けるようになりましたが、1947年（昭和22）11月から雑誌が、1948年（昭和23）7月から新聞が事後検閲に戻り、1949年（昭和24）からは事後検閲も表面上は廃止となり、1952年（昭和27）4月28日の「サンフランシスコ平和条約」発効により失効しました。以下に、「言論及び新聞の自由に関する覚書」（SCAPIN-16）の英語版・日本語訳・現代語訳を掲載しておきますので、ご参照下さい。

MEMORANDUM FOR：THE IMPERIAL JAPANESE GOVERNMENT.

FROM：THE SUPREME COMMANDER FOR THE ALLIED POWERS.

1. The Japanese Imperial Government will issue the necessary orders to prevent dissemination of news, through newspapers, radio broadcasting or other means of publication, which fails to adhere to the truth or which disturbs public tranquillity.

2. The Supreme Commander for the Allied Powers has decreed that there shall be an absolute minimum of restrictions upon freedom of speech. Freedom of discussion of matters affecting the future of Japan is encouraged by the Allied Powers, unless such discussion is harmful to th efforts of Japan to emerge from defeat as a new nation entitled to a place among the peace-loving nations of the world.

3. Subjects which cannot be discussed include Allied troop movements which have not been officially released, false or destructive criticism of the Allied Powers, and rumors.

4. For the time being, radio broadcasts will be primarily of a news, musical and entertainment nature. News, commentation and informational broadcasts will be limited to those originating at Radio Tokyo Studios.

5. The Supreme Commander will suspend any publication or radio station which publishes information that fails to adhere to the truth or disturbs public tranquillity.

言諭及新聞ノ自由ニ關スル覺書

一九四五年九月一〇日

一、　日本帝國政府ハ新聞、ラジオ放送又ハ其ノ他ノ出版物等ニ依リ、眞實ニ符合セズ若ハ公安ヲ害スルニユ一スヲ頒布セザルヤウ必要ナル命令ヲ發スベシ。

二、　聯合國最高司令官ハ言論ノ自由ニ關シテハ最少限度ノ制限ヲ爲スベキ旨ヲ命ジタリ。日本ノ將來ニ關スル事項ノ討論ノ自由ハ日本ガ敗戰ヨリ世界ノ平和愛好國家ノ仲間入リスル資格ヲ有スル新ナル國家トシテ出發セントスル日本ノ努力ニ有害ナラザル限リ聯合國ニヨリ奬勵セラル。

三、　公式ニ發表セラレザル聯合國軍隊ノ動靜、聯合國ニ對スル虛僞又ハ破壞的批評及ビ風說ハ之ヲ論議スルコトヲ得ズ。

四、　當分ノ內ラジオ放送ハ主トシテニユース及音樂的娛樂的性質ノモノヲ取扱フベシ。ニユース、解說及ビ情報的放送ハ東京放送局ヨリ放送サルルモノニ限ル。

五、　最高司令官ハ眞實ニ符合セズ又ハ公安ヲ害スルガ如キ報道ヲ爲ス出版物若ハ放送局ニ對シテハ發行禁止又ハ業務停止ヲ命ズ。

１．日本帝国政府は、新聞、ラジオ放送等の報道機関が、真実に合致せずまた公共の安寧を妨げるべきニュースを伝播することを禁止する所要命令を発出すべきこと。

２．最高司令官は、今後言論の自由に対して絶対最小限の規制のみを加える旨告示している。連合国は日本の将来に関する論議を奨励するが、世界の平和愛好国の一員として再出発しようとする新生日本の努力に悪影響をあたえるような論議は取締るものとする。

３．公表されざる連合国軍隊の動静、および連合国に対する虚偽の批判もしくは破壊的批判、流言蜚語は取締るものとする。

４．当分の間、ラジオ放送はニュース、音楽および娯楽番組に限定される。ニュース解説および情報番組は、東京中央放送局制作のものに限定される。

５．最高司令官は、真実に反しもしくは公共の安寧を妨げるが如き報道を行った新聞・出版・放送局の業務停止を命じることがある。

連合国最高司令部（GHQ）より「商事会社の解体に関する覚書」 (SCAPIN-1741) が指令される

　今日は、昭和時代中期の占領下の1947年（昭和22）に、連合国最高司令部（GHQ）より「商事会社の解体に関する覚書」 (SCAPIN-1741) が指令された日です。
　「商事会社の解体に関する覚書（しょうじがいしゃのかいたいにかんするおぼえがき）」は、太平洋戦争敗戦後の占領下での、連合国最高司令部（GHQ）から出された指令（SCAPIN）の一つで、連合国最高司令官指令第1741号（SCAPIN-1741）のことでした。内容は、三菱商事と三井物産に徹底的な解体を命令したもので、両社は100社以上に分割されています。
　「ポツダム宣言」を受諾して無条件降伏した日本政府に対して、占領軍はその宣言にある軍国主義の除去について、各種の連合国最高司令官指令を出しましたが、戦時中の財閥は軍国主義を担った重要な勢力とみなされ、まず、1945年（昭和20）11月6日付で日本政府宛に「持株会社の解体に関する覚書」（SCAPIN-244）で、持ち株会社の解体を指示します。続いて、翌年7月23日付で日本政府宛に「持株会社清算委員会に影響する法令に關する覚書」（SCAPIN-1079）を出し、それに基づいて、4月20日に「持株会社整理委員会令」（昭和21年勅令第233号）が発令されて具体化されていきました。
　三井物産と三菱商事は、1946年（昭和）12月28日に持株会社に指定され、その整理を迫られていましたが、「整理は日本経済の弱体化に繋がる」として再考を求めるロビー活動を起こします。これは、財閥温存を図るものとされて、GHQの担当者の反感を招き、この指令によって、より厳しい整理措置を採るように、具体的な内容を示して要求したものでした。
　この後、両社の解体が進められ、1950年（昭和25）3月1日に、三井物産が日東倉庫建物、同年4月1日に三菱商事が光和実業に継承される形で、戦前の2大商社の解体が事実上完了します。

Subject：Dissolution of Trading Companies

1. Reference are:
a. Memorandum to the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers, AG 004 (6 Nov 45) ESS/ADM, (SCAPIN 244), dated 6 November 1945, subject: Dissolution of Holding Companies.
b. Memorandum to the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers, AG 091.3 (23 Jul 46) ESS/AC, (SCAPIN 1079), dated 23 July 1946, subject: Ordinances and Regulations Affecting the Holding Company Liquidation Commission.
c. Ordinance No. 233 of 1946.
d. Letter of Designation from the Prime Minister, dated 28 December 1946, Cabinet A 449.

2. In implementation of reference Memoranda and Ordinance, the following action will be taken:
a. Immediate commencement of dissolution and liquidation of the Mitsubishi Trading Company and the Mitsui Trading Company.
b. Prohibit the conduct of any business transactions or the transfer of any assets by said companies without the permission of the Holding Company Liquidation Commission, or such other agencies as may be designated, on and after the date of this memorandum.
c. Prohibit any persons who have been officers, directors, advisers, branch managers of foreign or domestic branches, or department or section heads of said companies, during a period of ten (10) years prior to the date of this memorandum, from associating together to form a new company, or more than two (2) being employed by or advising any one (1) existing company or company hereafter formed.
d. Prohibit any group of employees in addition to those specified in paragraph c, above, exceeding one hundred (100) in number, from organizing a new company, being employed by any one (1) existing company, or any company hereafter formed, without permission of the Holding Company Liquidation Commission or such other agencies as may be disignated. The Holding Company Liquidation Commission or such other agencies shall grant such permission if it shall conclusively appear that a possibility of recreation of the dissolved companies or other monopolistic combinations shall not result.
e. Prohibit any trading company in which any officers or employees of both said companies shall be employed from occupying any office now used or formerly used by either of said companies as a business office, and further prohibit any company from using the firm name Mitsubishi Trading Company or Mitsui Trading Company, or any resemblance thereof.
f. Require said, companies to immediately prepare, in detail, inventories of all assets, showing location, and submit same to the Holding Company Liquidation Commission.
g. Require the maintenance of all existing books and records of said companies.

3. In carrying out the provisions of the memorandum:
a. All assets of said companies shall be disposed of in accordance with existing legislation and ordinances, by open market sale, or in such other manner as may be fair and equitable.
b. The Holding Company Liquidation Commission may remove any officers of said companies or appoint officers to act as liquidators.
c. The Holding Company Liquidation Commission may require the companies to furnish reports and information or inspect any books or records.

4. The Japanese Government shall immediately furnish to the Supreme Commander for the Allied Powers a report of action taken in compliance with this memorandum.

1. 次の各文書を參照すること：
　a. 一九四五年一一月六日付連合國最高司令部發日本政府宛の覺書（SCAPIN244）「持株會社の解體」に關する件
　b. 一九四六年七月二三日付連合國最高司令部發日本政府宛の覺書（SCAPIN1079）「持株會社整理委員會に關する命令及び規則」に關する件
　c. 一九四六年勅令第二三三號
　d. 一九四六年一二月二三日付內閣總理大臣の指定通知書、內閣A第四四九號

2. 參照各覺書及び法令の實施として、以下の措置がとられねばならない。
　a. 三菱商事會社及び三井物產會社の解散及び淸算の即時開始
　b. 本覺書の日付當日又はその後に於て、持株會社整理委員會又は指定されることある他の同樣の機關の許可なしに、右二會社があらゆる商取引をなし又は資產を處分することを禁止すること。
　c. 本覺書の日付に先き立つ一〇年間に、右二會社の役員、取締役、顧問、國外若くは國內の支店長、又は部長課長であつた者が、新會社を設立するために協同したり、或は二名以上が現存の又は今後設立される一會社に雇われ又はその顧問となることを禁止すること
　d. 上記c項に明記された者のほか、百名を超える被傭者の群が、持株會社整理委員會又は指定されることある他の同樣の機關の許可なしに、新會社を組織したり、或は現存の又は今後設立される一會社に雇われることを禁止すること。持株會社整理委員會又は他の同樣の機關は、解體された二會社又は他の獨占的合同を再現するに至る可能性が絕對にないと認められる場合に、右の許可を與えること。
　e. 右兩會社の役員又は被傭者を雇傭する商事會社が、右兩會社の何れかが現在使用しているか又は過去において使用していた一切の事務所を事務所として使用することを禁止し、更に又、いかなる會社に對しても三菱商事又は三井物產なる商號或はその類似の名稱の使用を禁止すること。
　f. 右二會社に對し、一切の資產の目錄を詳細なその所在をも示して、直ちに作成し、右目錄を持株會社整理委員會に提出するよう要求すること。
　g. 右二會社の現存する一切の帳簿及び記錄の保存を要求すること。

3. 本覺書の規定を實施するにあたつて：
　a. 右二會社の一切の資產は、現存の法令に從つて、公開市場の賣却又はその他の公明妥當な方法によつて處分されねばならない。
　b. 持株會社整理委員會は右二會社の役員を解任し、又は淸算人として行動する役員を任命することを得る。
　c. 持株會社整理委員會は、右會社に報吿書及び情報の提出を要求し、又はその帖簿記錄を檢查することが出來る。

4. 日本政府は、この覺書に從つて取つた處置に關する報吿を、連合國最高司令官に直ちに提出せねばならない。
